Welcome to The Shirt Shop, Etc. These Terms and Conditions govern your use of our website (https://shirtshopetc.com/) and the custom printing services we provide. By accessing our website or placing an order with us, you agree to be bound by these Terms and Conditions. Please read them carefully.

1. Definitions

Throughout these Terms and Conditions, the following terms shall have the meanings assigned to them below:

• "Company," "we," "us," or "our" refers to The Shirt Shop, Etc., located at 12532 Taylor Mill Rd, Laurel, DE, 19956-2716, United States.
• "Customer," "you," or "your" refers to any individual or entity that accesses our website or places an order for our services.
• "Services" refers to the custom printing services we provide, including screen printing, digital printing, and embroidery on apparel and other items.
• "Website" refers to https://shirtshopetc.com/ and all its associated pages.
• "Order" refers to a request placed by a Customer for our Services.
• "Artwork" refers to any designs, logos, text, or other content provided by the Customer for printing.

2. Acceptance of Orders

All orders are subject to acceptance by us. We reserve the right to refuse any order for any reason, including but not limited to:

• Artwork that contains offensive, defamatory, or inappropriate content
• Artwork that infringes on intellectual property rights
• Technical limitations that prevent us from fulfilling the order to our quality standards
• Insufficient or unclear order specifications

An order is not considered accepted until we have sent you an order confirmation via email. If you do not receive an order confirmation within 48 hours of placing your order, please contact us at aleenabender@shirtshopetc.com or call (302) 715-5634.

3. Pricing and Payment

3.1 Pricing

All prices displayed on our website are in US Dollars and do not include applicable taxes or shipping costs unless explicitly stated. Prices are subject to change without notice. The final price for your order will be provided in your quote or order confirmation.

3.2 Quotes

Quotes are valid for 30 days from the date of issuance unless otherwise specified. Quotes are based on the information provided at the time of the request. Any changes to order specifications may result in price adjustments.

3.3 Payment Terms

For orders under $500, full payment is required at the time of order placement. For orders over $500, a 50% deposit is required to begin processing, with the remaining balance due prior to shipping or pickup.

We accept payment via credit card (Visa, MasterCard, American Express, Discover), PayPal, and business checks (for established business customers only). Business checks must clear before production begins.

4. Production and Delivery

4.1 Production Timeline

Standard production time is 7-10 business days after artwork approval and payment receipt. Rush orders may be available for an additional fee, subject to our production schedule. Production times are estimates and not guarantees.

4.2 Proofs and Approval

We will provide digital proofs for your approval before production begins. Production will not start until you have approved the final proof in writing (via email). You are responsible for carefully reviewing all proofs for accuracy, including design, color, placement, spelling, and grammar.

Once you approve a proof, you accept full responsibility for the accuracy of the content. We are not responsible for errors in approved proofs.

4.3 Delivery

Delivery times are estimates and may vary based on shipping method and destination. We are not responsible for delays caused by shipping carriers or customs processing for international orders.

Risk of loss transfers to you upon delivery to the carrier. You are responsible for providing accurate shipping information. Additional charges may apply for address changes after an order has shipped.

5. Intellectual Property

5.1 Customer Artwork

By submitting artwork to us, you represent and warrant that:

• You own or have obtained all necessary rights and permissions to use the artwork
• The artwork does not infringe on any third party's intellectual property rights
• The artwork does not contain any illegal, offensive, or defamatory content

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your breach of these representations.

5.2 Our Intellectual Property

All content on our website, including but not limited to text, graphics, logos, images, and software, is our property or the property of our licensors and is protected by copyright and other intellectual property laws.

We retain ownership of all designs created by our design team, unless otherwise agreed in writing. You may not use our designs for any purpose other than the specific order for which they were created without our written permission.

6. Product Quality and Variations

We strive to maintain the highest quality standards for all our products. However, please note the following:

• Minor variations in color between digital proofs and printed products may occur due to differences between screen display and printed output.
• Slight variations in placement (up to 1/2 inch) are considered within industry standards and do not constitute a defect.
• Apparel items may have slight variations in size, color, and texture as provided by manufacturers.
• Pre-production samples are available for an additional fee if exact color matching is critical to your order.

7. Returns and Refunds

Due to the custom nature of our products, all sales are final. We do not accept returns or offer refunds except in the following circumstances:

• Products with manufacturing defects
• Products that significantly deviate from approved proofs
• Incorrect quantities shipped

Claims must be submitted within 5 business days of receiving your order. Please contact us at aleenabender@shirtshopetc.com with photos of the issue and your order number.

If a claim is approved, we may, at our discretion, offer a reprint, partial refund, or full refund. Reprinted items must be returned to us at our expense before replacement items are shipped.

8. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use our services
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any errors or omissions in any content or for any loss or damage of any kind incurred as a result of your use of any content

Our total liability for any claims under these Terms and Conditions shall not exceed the amount you paid for the order giving rise to such claim.

9. Cancellations

You may cancel an order at any time before production begins without penalty. Once production has begun, cancellation fees will apply as follows:

• After artwork approval but before printing: 25% of order total
• During printing process: 50% of order total
• After printing is complete: 100% of order total (no cancellation)

10. Privacy Policy

Your privacy is important to us. Our Privacy Policy, available at Privacy Policy, explains how we collect, use, and protect your personal information. By using our website or services, you consent to the collection and use of information as described in our Privacy Policy.

11. Governing Law and Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms and Conditions shall be resolved through the following process:

1. Informal negotiation: The parties will attempt in good faith to resolve any dispute promptly through negotiation.
2. Mediation: If negotiation is unsuccessful, the parties will attempt to resolve the dispute through mediation in Delaware under the rules of the American Arbitration Association.
3. Litigation: If mediation is unsuccessful, either party may initiate litigation in the state or federal courts located in Delaware, and both parties consent to the exclusive jurisdiction of these courts.

12. Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemic, epidemic, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, flood, accident, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

13. Modifications to Terms and Conditions

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to our website. Your continued use of our website or services after any changes indicates your acceptance of the modified Terms and Conditions.
